TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your participation in activities operated by Hafiz's Cherating Activities ("we," "us," or "our"). By booking and participating in our activities, you agree to these Terms.

SECTION 1: BOOKING & PAYMENT

1.1 BOOKING CONFIRMATION

Your booking is confirmed only when:

  • You receive a confirmation email with booking reference
  • All participant information is provided

1.2 PAYMENT TERMS

  • All prices are in {{CURRENCY}}
  • Prices include service charges unless stated otherwise

1.3 PRICING CHANGES

We reserve the right to change prices at any time. However, confirmed bookings will be honored at the price paid.

SECTION 2: YOUR RESPONSIBILITIES

2.1 ACCURATE INFORMATION

You must provide:

  • Correct participant names and contact details
  • Accurate age information
  • Relevant medical conditions or special requirements
  • Emergency contact information

2.2 ARRIVAL & PUNCTUALITY

  • Arrive at least 15 minutes before scheduled start time
  • Bring confirmation and identification
  • Late arrivals may forfeit participation without refund
  • No-shows are considered cancellations without refund

2.3 BEHAVIOR STANDARDS

Participants must:

  • Follow all instructions from staff
  • Respect other participants and staff
  • Not be under influence of alcohol or drugs
  • Maintain appropriate conduct at all times

SECTION 3: CANCELLATIONS & REFUNDS

3.1 CUSTOMER CANCELLATIONS

Please refer to our separate Refund Policy for detailed cancellation terms and refund percentages based on timing.

3.2 OUR RIGHT TO CANCEL

We may cancel activities due to:

  • Insufficient bookings (minimum numbers not met)
  • Safety concerns or emergencies
  • Weather conditions (if applicable)
  • Operational issues beyond our control

If we cancel, you will receive a full refund or option to reschedule.

SECTION 4: CHANGES & MODIFICATIONS

4.1 CUSTOMER CHANGES

  • Date changes subject to availability and may incur fees
  • Participant name changes allowed up to 24 hours before activity
  • No changes permitted within 24 hours of activity

4.2 OPERATIONAL CHANGES

We reserve the right to:

  • Modify itineraries for safety or operational reasons
  • Substitute equipment or venues of similar standard
  • Change staff or guides as needed
  • Adjust timings within reasonable limits

SECTION 5: PARTICIPANT REQUIREMENTS & SAFETY

5.1 WHO CAN PARTICIPATE

This activity is suitable for most people in reasonable health.

5.2 MEDICAL CONDITIONS

Please inform us at the time of booking if you or any participant:

  • Has any medical condition that may affect participation
  • Has mobility limitations
  • Requires special assistance or accommodation
  • Is pregnant
  • Takes medication that may cause drowsiness or affect balance

5.3 SAFETY GUIDELINES

For your safety, you must:

  • Follow the guide's instructions at all times
  • Stay with the group
  • Wear appropriate clothing and footwear
  • Bring adequate sun protection and water

SECTION 6: LIABILITY & INSURANCE

6.1 ASSUMPTION OF RISK

By participating, you acknowledge and accept:

  • Activities involve inherent risks
  • You participate voluntarily and at your own risk
  • You are responsible for assessing your own capabilities
  • Following safety instructions minimizes but doesn't eliminate risk

6.2 LIABILITY LIMITATIONS

To the maximum extent permitted by law:

  • We are not liable for personal injury or property damage
  • We are not responsible for lost, stolen, or damaged belongings
  • Our liability is limited to the activity fee paid
  • We are not liable for indirect or consequential losses

6.3 INSURANCE RECOMMENDATION

We strongly recommend:

  • Travel insurance covering adventure activities
  • Medical insurance with emergency evacuation
  • Personal property insurance
  • Trip cancellation insurance

SECTION 7: PHOTOGRAPHY & MARKETING

7.1 PHOTOGRAPHY DURING ACTIVITIES

  • We may take photos/videos during activities
  • Images may be used for marketing purposes
  • Inform us if you prefer not to be photographed
  • Professional photography services may be available

7.2 PERSONAL PHOTOGRAPHY

  • Personal photos allowed unless safety prohibits
  • Drone usage requires prior permission
  • Respect other participants' privacy
  • No commercial use without our consent

SECTION 8: WEATHER & ENVIRONMENTAL CONDITIONS

8.1 WEATHER-DEPENDENT ACTIVITIES

Our activities are subject to weather conditions for your safety and enjoyment.

8.2 CANCELLATIONS DUE TO WEATHER

We reserve the right to cancel or modify activities due to:

  • Heavy rain, storms, or lightning
  • Strong winds or rough seas
  • Poor visibility conditions
  • Extreme temperatures
  • Natural disasters or warnings

8.3 WEATHER DECISIONS

  • Weather calls are made by our experienced team
  • Decisions prioritize safety over convenience
  • We monitor conditions up to departure time
  • Alternative dates or full refunds offered for weather cancellations

8.4 YOUR RESPONSIBILITIES

  • Check weather forecasts before your activity
  • Dress appropriately for conditions
  • Bring weather protection (sunscreen, rain gear)
  • Respect our weather-related decisions

SECTION 9: SPECIAL REQUIREMENTS

9.1 DIETARY REQUIREMENTS

  • Inform us of dietary needs at booking
  • We'll accommodate where possible
  • Some remote locations have limited options
  • Bring personal snacks if severely restricted

9.2 ACCESSIBILITY

  • Discuss accessibility needs before booking
  • Not all activities suitable for all abilities
  • We'll suggest suitable alternatives where possible
  • Assistance animals permitted with prior notice

SECTION 10: COMPLAINTS & DISPUTES

10.1 COMPLAINT PROCEDURE

If you have concerns:

  1. Raise them immediately with staff on-site
  2. Contact our office within 48 hours
  3. Submit written complaint within 7 days
  4. We'll investigate and respond within 14 days

10.2 DISPUTE RESOLUTION

  • Initial resolution through direct negotiation
  • Mediation if direct resolution fails
  • Arbitration as final resort

SECTION 11: GENERAL TERMS

11.1 ENTIRE AGREEMENT

These Terms constitute the entire agreement between parties and supersede all prior agreements or understandings.

11.2 SEVERABILITY

If any provision is found invalid, other provisions remain in full force and effect.

11.3 WAIVER

Failure to enforce any provision does not constitute waiver of that provision.

11.4 GOVERNING LAW

These Terms are governed by applicable local laws.
